- Agree that you are solely responsiblefor ensuring that any person or image included in your Contribution has given proper consent or authorization for use.
7. Image Use, Events, and Takedown Procedure
7.1 Sources
We use images (i) captured at industry events and conferences by us or external photographers, and (ii) submitted by article authors, companies, or collaborators.
7.2 Public Events
Images taken at industry events or conferences are considered part of public editorial coverage. Attendees at such events generally have reduced expectations of privacy regarding image use in editorial publications.
7.3 Contributor Submissions
Anyone who submits an image for publication on the Site represents and warrants that they are authorized to do so and have secured necessary rights and/or consents for editorial use by The Elite Officer, LLC.
7.4 Takedown Requests
If you believe your image appears on the Site without valid authorization, you may request removal by emailing assistant@theeliteofficer.com and providing:
- The exact URL(s)where the image appears;
- A screenshotof the image clearly identifying the individual;
- Your full name, contact details, and a short explanation;
- Proof of identity(and, if acting for someone else, proof of authority).
7.5 Review Timeline
We will review your request in good faith and respond within 30 days. If appropriate, we will remove the image. If we have valid rights or consent, we may choose to retain it.
7.6 Third-Party Responsibility
If the image was submitted by a third party who declared they were authorized, we may forward your request to that party or request further verification.
7.7 External Removal
Removing an image from the Site does not guarantee its removal from search engines, social media, or cached platforms.
8. Pre-Claim Resolution Requirement
Before taking any legal or formal action against The Elite Officer, LLC, you must first submit a detailed claim by email to assistant@theeliteofficer.com including:
- Your full name and contact info;
- A description of the issue or dispute;
- Any supporting documentation or links;
- The remedy you seek.
We will review and respond within 30 days. Failure to complete this process may result in you being responsible for legal fees and costs incurred due to omission of this step.
9. Dispute Resolution and Governing Law
9.1 Arbitration
All disputes not resolved through the above process will be settled by binding arbitration in Miami-Dade County, Florida, under the rules of either the AAA or JAMS, selected at our discretion.
9.2 No Class Actions
You agree to resolve any disputes individually, and waive your right to participate in any class action or class-wide arbitration.
9.3 Governing Law
These Terms are governed by the laws of the State of Florida and applicable U.S. federal laws.
10. DMCA Compliance
If you believe that content on our Site infringes your copyright, you may submit a DMCA notice to assistant@theeliteofficer.com. Your notice must include:
- Your physical or electronic signature;
- Identification of the copyrighted work;
- Identification of the allegedly infringing content and its URL;
- Your contact information;
- A statement of good faith belief;
- A statement that the information is accurate and that you are authorized to act on behalf of the copyright owner, under penalty of perjury.
We may remove or disable access to the content after a valid notice and notify the content provider. A counter-notification process is also available.
11. Privacy Policy
Use of this Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your data.
12. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available.” We make no warranties or guarantees regarding the accuracy, reliability, or availability of the Site or its content.
13. Limitation of Liability
To the fullest extent permitted by law, The Elite Officer, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill), even if we were advised of the possibility.
Total liability for any claim will not exceed the greater of $100 USD or the amount paid by you to us, if any, in the 12 months preceding the incident.
